SECTION _____.  CONFORMING AMENDMENT.  Subchapter A, Chapter 2051, Insurance Code, is amended by adding Section 2051.003 to read as follows:

Sec. 2051.003.  CERTAIN LAWS NOT APPLICABLE.  The following laws, as they relate to setting and promulgating rates for fire insurance or prescribing fire insurance policies and forms, do not apply to establishing classifications for workers' compensation insurance, setting workers' compensation insurance rates, or prescribing workers' compensation insurance policy forms:

(1)  Subchapter C, Chapter 5;

(2)  Subchapter H, Chapter 544;

(3)  Subchapter D, Chapter 1806; and

(4)  Chapters 2001, 2002, 2003, 2004, 2005, 2006, and 2171.  (V.T.I.C. Art. 5.66 (part).)

Art. 5.66.  No provision of Chapter 5, subchapter C of this code, with regard to the fixing and promulgation of rates for fire insurance or the prescribing of fire insurance policies and forms shall be applicable to the fixing of compensation insurance classifications or the making of compensation insurance rates or the prescribing of compensation insurance policy forms; … .

Revisor's Note

V.T.I.C. Article 5.66 provides that "[n]o provision of Chapter 5, subchapter C of this code … shall be applicable to the fixing of compensation insurance classifications … ."  Included in Subchapter C, V.T.I.C. Chapter 5, were Articles 5.41-2, 5.43-1, 5.43-2, 5.43-3, 5.43-4, 5.44, 5.49, 5.53, and 5.54.  Article 5.41-2 was revised in 2005 as Section 403.002 of this code, Article  5.43-1 is revised, effective April 1, 2009, as Chapter 1959, Occupations Code, Article 5.43-2 is revised, effective April 1, 2009, as Chapter 1960, Occupations Code, Article 5.43-3 is revised, effective April 1, 2009, as Chapter 1961, Occupations Code, Article 5.43-4 was revised in 1999 as Chapter 2154, Occupations Code, Article 5.44 was revised in 1987 as Section 417.008, Government Code, Article 5.49 was revised in part in 2003 in Chapter 251 of this code and in part, effective April 1, 2007, in Chapter 252 of this code, and Articles 5.53 and 5.54 were revised in part, effective April 1, 2007, as Chapter 1807 of this code.  The revised law does not reference the statutes revising those articles because those provisions do not regulate rates for fire insurance or fire insurance policies or forms.
