REVISOR'S NOTE, SUBCHAPTER A, CHAPTER 885

Revisor's Note

V.T.I.C. Article 3.38 provides that nothing in V.T.I.C. Chapter 3 applies to a fraternal benefit society.  Section 885.002(a) of this code provides that, except as provided by Chapter 885, a fraternal benefit society is governed by Chapter 885 and is "exempt from all other insurance laws of this state for all purposes." Section 885.002(b) of this code further states that a law enacted after July 1, 1913, does not apply to a fraternal benefit society unless a fraternal benefit society is expressly designated in the law. V.T.I.C. Chapter 3 has been revised in numerous locations in this code.  A provision formerly in V.T.I.C. Chapter 3 that specifically applied to a fraternal benefit society has been revised to retain the provision's applicability to a fraternal benefit society.  Similarly, a provision formerly in V.T.I.C. Chapter 3 that expressly or otherwise did not apply to a fraternal benefit society has been revised to retain the provision's original applicability and meaning.  Therefore, the revised law omits Article 3.38 as unnecessary.  The omitted law reads:

Art. 3.38.  Nothing in this chapter shall be held to apply to fraternal benefit societies as defined by the laws of this State.
